Injury-Liability Waiver

1. Acknowledgment of Risk
GymiaFit (the "App", operated by Gymia, based in Italy) provides exercise programs, workout plans, nutrition suggestions, and AI-generated training guidance. You understand that physical exercise — including but not limited to resistance training, cardiovascular activity, stretching, and high-intensity training — carries inherent risks. These risks include, without limitation: muscle strains, sprains, fractures, joint injuries, cardiovascular events, heat-related illness, and in rare cases serious injury or death.
You acknowledge that these risks cannot be eliminated regardless of the care taken, and that they may arise from your own actions, the actions of others, equipment, or pre-existing medical conditions.
2. Medical Fitness to Participate
You confirm that you are physically able to participate in an exercise program. You agree to consult a qualified physician before beginning any program offered through the App, particularly if you:
- have a heart condition or chest pain during physical activity;
- experience dizziness, fainting, or loss of balance;
- have a bone, joint, or musculoskeletal problem;
- take medication for blood pressure or a heart condition;
- are pregnant, recently gave birth, or are recovering from surgery or injury;
- have any other condition that may be affected by physical activity.
You agree to stop exercising and seek medical attention if you experience pain, discomfort, dizziness, or shortness of breath.
3. Assumption of Risk
You voluntarily choose to participate in physical activity using the App. You knowingly and freely assume all risks, both known and unknown, associated with that participation, and you accept full responsibility for your own health, safety, and exercise decisions.
4. Release and Waiver of Liability
To the fullest extent permitted by applicable law, you release, waive, and discharge Gymia, GymiaFit, and their owners, employees, and partners from any and all liability, claims, or demands for injury, illness, loss, or damage arising out of or related to your use of the App and your participation in any exercise or nutrition program, except where such liability cannot be excluded under mandatory law (including liability for death or personal injury caused by gross negligence or wilful misconduct).
5. AI-Generated Guidance
The App uses artificial intelligence to generate workout plans, exercise substitutions, and nutrition suggestions. This guidance is automatically generated, is not reviewed by a medical professional, and may not be appropriate for your individual circumstances. It is provided for general informational purposes only and is not a substitute for professional medical, physiotherapy, or dietary advice.
6. No Medical Advice
Nothing in the App constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition or before starting, changing, or stopping any exercise or nutrition program.
7. Minors
You must be at least 13 years old to use the App. If you are under the age of legal majority in your country, you may only use the App and accept this waiver with the consent and supervision of a parent or legal guardian, who accepts these terms on your behalf.
8. Governing Law and Severability
This waiver is governed by the laws of Italy. If any provision of this waiver is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be applied to the maximum extent permitted by law.
9. Acceptance
By accepting this waiver in the App and by using GymiaFit, you confirm that you have read and understood it, that you assume the risks of physical exercise, and that you agree to its terms freely and voluntarily.
